Description:

The research is devoted to providing a comprehensive analysis and evaluation of the current system governing compensation for work-related accidents and occupational diseases in the Czech Republic. It focuses on the assessment of the costs of various compensation models and their impact on the state budget, employers and injured employees. Particular attention is being devoted to determining an optimal compensation model that ensures suitable levels of compensation for injured employees and, at the same time, is sustainable in terms of the costs for all the parties involved. The degree of the involvement of employers in terms of accident prevention within the proposed system is also considered an important factor.

The currently valid legal regulations set out in the Labour Code rather than constituting statutory liability insurance for damage incurred, provide a means for securing liability relationships via statutory insurance. Thus, with respect to liability for damage to health, in the case that the injured party is in an employment relationship, the insurance company reimburses the employer for the compensation for damage it provided to the employee or, on the basis of instructions provided by the employer, provides compensation for damage on behalf of the employer directly to the injured party or to other authorised natural persons.
