Notifications of breaches of EU Legislation

Submission of notifications under Directive (EU) 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of European Union legislation (hereinafter referred to as the “Directive”)

Robin Maialeh, Ph.D., Director of RILSA (hereinafter referred to as “RILSA”), in accordance with the above-mentioned EU Directive 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of persons who report breaches of EU legislation, hereby provides information for whistleblowers, whose rights are protected by the Directive with concern to the notification process.

The aim of the Directive is to protect whistleblowers from retaliatory measures following the reporting of a breach of EU legislation. The benefit for RILSA lies in the timely revelation of illegal or dubious procedures and practices at the institution.

However, the aim of the Directive is not to protect whistleblowers who report knowingly false information.

Notification

Natural persons provide information on an illegal act, the performance of which the notifying party discovered in connection with their work or other similar activity:

  • that has the character of a criminal offence or misdemeanour;
  • that violates a legal regulation or an EU regulation pertaining to the areas set out in the Directive.

Notifications can be submitted in the following ways

  • in writing via email: oznameni@rilsa.cz;
  • via telephone: +420 211 152 711;
  • in person following agreement with the designated responsible person;
  • via the external notification system operated by the Ministry of Justice: https://oznamovatel.justice.cz/;
  • publication (provided the relevant legal conditions are fulfilled).

Notifications can also be communicated anonymously.

The Research Institute for Labour and Social Affairs has established an internal system for both receiving such notifications, which guarantees the anonymity of the notifying party, and the management of submissions by whistleblowers, including the setting of deadlines for the processing of notifications and the filing thereof.

Responsible person

The designated responsible person is the only person who is permitted to familiarise him/herself with such notifications, assess them, take further action and propose corrective measures.

Process for the handling of notifications

  1. Notifications can be submitted orally or in writing or, at the request of the notifying party, in person.
  2. The responsible person must notify the notifying party of having received the notification within 7 days.
  3. The notifying party must be informed of the outcome of the review process within 30 days.
  4. The deadline can be extended twice, but by a maximum of 30 days.
  5. The responsible person is obliged to propose measures aimed at preventing or remedying the illegal act.
  6. Notifications must be archived for 5 years.
